These Terms of Service ("Terms") govern your use of the tinystat analytics service ("Service") operated by tinystat ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Service Description

tinystat provides privacy-first web analytics. We offer a lightweight tracking script that website owners embed on their sites to collect anonymous, aggregated visitor statistics. The Service includes a web dashboard for viewing analytics data and an API for programmatic access.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You are responsible for all activity that occurs under your account.

You must be at least 16 years old to create an account. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Acceptable Use

You agree not to use the Service to:

  • Track websites that contain illegal content under applicable law
  • Attempt to reverse-engineer, modify, or tamper with the tracking script to collect personal data
  • Send artificial or bot traffic to inflate analytics numbers
  • Resell or redistribute the Service without written permission
  • Use the Service in any way that could damage, disable, or impair the Service's infrastructure
  • Abuse the API with excessive requests beyond reasonable usage

4. Data Processing Role

tinystat acts as a data processor on your behalf when collecting analytics for your websites. Because tinystat does not collect or store personal data (as defined by the GDPR), a formal Data Processing Agreement (DPA) is not required. If you believe your use case involves personal data processing, please contact us to discuss.

5. Plan Limits and Enforcement

Each plan includes a monthly pageview allowance: Free (1,000 views/mo), Starter (10,000 views/mo), Pro (100,000 views/mo), and Executive (500,000 views/mo). Site limits vary by plan: Free (1 site), Starter (5 sites), Pro (10 sites), and Executive (unlimited).

When your site exceeds its monthly pageview limit, new pageviews will stop being recorded for the remainder of the billing cycle. Your existing data remains fully accessible. We will not delete or restrict access to previously recorded analytics data due to plan limits.

You may upgrade your plan at any time to resume recording. Pageview counts reset at the beginning of each billing cycle.

6. Payment Terms

Paid plans are billed monthly or annually through Stripe. All payment processing is handled by Stripe. We do not store your credit card information.

Prices are listed in USD. You may cancel your subscription at any time. Upon cancellation, your paid plan remains active until the end of the current billing period, after which your account reverts to the Free plan.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing cycle.

7. Uptime and Availability

We strive to maintain high availability of the Service but do not guarantee any specific uptime percentage. The Service is provided on a "best effort" basis.

Free plan accounts do not include any service level agreement. Paid plans receive priority support, but no formal SLA is offered at this time. We will communicate planned maintenance and outages through our status page and email.

8. Intellectual Property

The Service, including all code, design, and documentation, is the intellectual property of tinystat. You retain ownership of your analytics data.

You may export your data at any time. Upon account deletion, all associated analytics data is permanently deleted immediately.

9. Limitation of Liability

To the maximum extent permitted by law, tinystat shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your account if you violate these Terms or engage in activity that could harm the Service or other users.

Upon termination, your right to use the Service ceases immediately. All associated analytics data is permanently deleted at the time of account deletion.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
